YOU AND CHUY'S DELIVERY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of representative or class action proceeding.

14.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual claim in small claims court if the claim qualifies under applicable small claims court rules, provided that the claim remains in small claims court and is not removed or appealed to a court of general jurisdiction.

14.5 Jury Trial Waiver
